1. Website Terms of Use & Privacy
-
This agreement is made between J. Wright Globemaker ("The Conservator") of Barn 5 Unit 4, Warren Park Heritage & Craft Centre, Green Tye, Much Hadham, SG10 6FF, and the individual or entity detailed in the Contract ("The Client").
-
By accepting these Terms, the Client warrants that they are the sole legal owner of the Item, or that they possess full authority from the legal owner to authorise the Conservator to carry out the agreed work, and that the Item is free of all liens, charges, and encumbrances. The Client shall indemnify and hold the Conservator harmless against all costs, claims, liabilities, and expenses arising from any third-party claim contesting ownership or the right to authorise treatment.
-
The Conservator will exercise reasonable care and diligence in accordance with the professional guidelines of the European Confederation of Conservator-Restorers' Organisations (ECCO). The Client acknowledges that antique Items are subject to natural deterioration, hidden structural weaknesses (e.g., internal pasteboard degradation), and material fatigue. If unforeseen internal damage is discovered, the Conservator will pause work and issue a revised condition report and estimate. The Conservator shall not be liable for unavoidable material failures occurring during the course of professionally executed conservation.
-
All estimates are exclusive of VAT and remain valid for 60 days. Payment is due within 30 days of the invoice date. Late payments shall accrue interest at the statutory rate prescribed by the Late Payment of Commercial Debts (Interest) Act 1998.
Estimates under £1000: A 50% non-refundable deposit is required prior to commencement; 50% upon completion.
Estimates over £1000: A 33% non-refundable deposit prior to commencement; 33% at the midway point; 34% upon completion. The Conservator exercises a general lien over the Item and reserves the right to retain possession until all outstanding invoices are cleared. In accordance with Section 12 and Schedule 1 of the Torts (Interference with Goods) Act 1977, if an Item remains uncollected and invoices unpaid for three (3) months following completion notification, the Conservator reserves the right, after serving statutory notice, to sell the Item to recover outstanding debts, storage fees, and costs of sale.
-
The risk of damage to or loss of the Item remains with the Client at all times. The Client agrees to maintain comprehensive insurance covering the Item for its full value against all risks (including fire, theft, and accidental damage) whilst it is in the custody of the Conservator and during transit. Nothing in this Contract limits liability for death or personal injury caused by negligence, or for fraud. Subject to this, the Conservator’s total liability for professional negligence or default shall be strictly capped at the total cost of the conservation work specified in the Contract. Liability for any indirect, consequential, or economic loss (including loss of eventual sale value) is expressly excluded.
-
The Conservator retains copyright over all related documentation, condition reports, and photographic records produced during the treatment process.
-
This Contract shall be governed by and construed in accordance with English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
2. Terms and Conditions for Conservation and Restoration
3. Terms and Conditions for Bespoke Globe Commissions
-
These Terms govern the supply of bespoke globes (the "Product") by J. Wright Globemaker ("The Maker") to the Client.
-
Because the Product is custom-mapped, hand-crafted, and tailored to the Client's exact specifications, the Client acknowledges that the statutory 14-day right to cancel under Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply. Once the design proof is approved and production commences, the commission is legally binding and non-refundable.
-
The Client must sign off on all final cartographic, structural, and aesthetic proofs. The Maker accepts no liability for errors (including spelling or coordinate mapping) approved by the Client at the proof stage. The Client accepts that traditional globemaking involves hand-cut gores, hand-tinting, and handmade shells; consequently, minor variations in alignment, colouration, and finish are inherent characteristics of the craft and do not constitute a defect under the Consumer Rights Act 2015.
-
To manage bespoke material sourcing and studio scheduling, payments are structured as follows:
40% non-refundable deposit to initiate design and secure the production slot.
30% interim payment upon final sign-off of the flat gores prior to shell application.
30% final balance (plus custom crating/transit costs) prior to dispatch. Production will be suspended if milestone payments are not received within 14 days of invoicing.
-
Title and ownership of the Product shall not pass to the Client until The Maker has received payment in full, including all transit and crating fees in cleared funds. The Risk in the Product transfers to the Client immediately upon collection from the studio, or upon handover to a designated third-party courier.
-
In accordance with the Copyright, Designs and Patents Act 1988, The Maker retains all underlying Intellectual Property rights, copyright, and design rights in the cartography, bespoke illustrations, and structural designs. The Client purchases the physical Product, not the right to reproduce it. The Maker reserves the perpetual right to photograph the Product for portfolio, exhibition, and marketing purposes, ensuring Client anonymity is preserved.
-
This Contract shall be governed by and construed in accordance with English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
-
This Agreement constitutes a contract of bailment for reward between J. Wright Globemaker ("The Owner") and the Hirer named in the invoice ("The Hirer"). "Equipment" refers to the globe, stand, custom transit crates, and any related accessories.
These Terms govern the supply of bespoke globes (the "Product") by J. Wright Globemaker ("The Maker") to the Client.
-
The Hirer assumes strict liability and absolute risk for the Equipment from the moment of dispatch/collection until it is safely returned to the Owner’s studio. The Hirer shall not alter, modify, repair, or attempt to clean the Equipment under any circumstances.
-
Prior to the release of the Equipment, the Hirer must provide a valid Certificate of Insurance explicitly covering the Equipment for its Full Replacement Value (as stated on the invoice) against all risks—including but not limited to transit, accidental damage, fire, and theft. The Owner must be named as a Loss Payee. Failure to provide adequate insurance certification entitles the Owner to refuse the release of the Equipment without refunding the hire fee.
-
The Hirer shall pay the agreed hire fee and a refundable Damage Bond in cleared funds prior to the hire period. The Bond will be returned within 7 days following a satisfactory condition inspection upon the Equipment's return. Should the Equipment be returned late, the Hirer agrees to pay a penalty fee of 150% of the daily pro-rata hire rate for each day the return is delayed, reflecting the disruption to the Owner's studio schedule. If the Equipment is damaged beyond the value of the Bond, the Hirer remains legally liable for the full cost of professional restoration or total replacement.
-
Subject to full payment, the Owner grants the Hirer a limited, non-exclusive, non-transferable license to feature the Equipment on-screen solely for the specific production/event detailed in the invoice. The Hirer acquires no copyright over the cartographic artwork and may not reproduce the globe's imagery for merchandising.
